Terms of Use
These Terms of Use (“Terms”) govern your access to and use of Pagetree at pagetree.net and related services (the “Service”), operated by Pagetree (“we”, “us”, “our”).
By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Pagetree.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian. You must provide accurate registration information and keep your account credentials secure.
2. The Service
Pagetree is a platform that lets you build and publish personal or business mini-websites (“Pages”), including links, media, widgets, and related tools. We may add, change, or remove features at any time. We do not guarantee uninterrupted or error-free operation.
3. Your account
You are responsible for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or pose a risk to the Service or other users.
4. Your content
You retain ownership of content you upload or publish (“Your Content”). You grant us a worldwide, non-exclusive license to host, store, reproduce, display, and distribute Your Content solely to operate and improve the Service (for example to show your public Page to visitors).
You represent that:
- You have the rights needed to publish Your Content;
- Your Content does not infringe intellectual property, privacy, or other rights of any person;
- Your Content complies with these Terms and applicable law.
We may remove or restrict content that violates these Terms, receives valid legal complaints, or creates risk for Pagetree or others. We are not obligated to monitor all content but may do so.
5. Acceptable use
You agree not to use Pagetree to:
- Break any law or encourage illegal activity;
- Publish malware, phishing, scams, or deceptive content;
- Harass, threaten, defame, or discriminate against others;
- Distribute spam or unsolicited commercial messages;
- Impersonate another person or misrepresent your affiliation;
- Collect personal data from others without lawful basis and notice;
- Attempt to probe, scan, or compromise our systems or other accounts;
- Circumvent plan limits, security measures, or access controls;
- Resell or sublicense the Service without our written permission.
We may investigate violations and cooperate with law enforcement where appropriate.
6. Public pages and visitors
Pages you publish are publicly accessible unless we offer private modes. You are responsible for what you share, including links to third-party sites. Visitors interact with your Page under their own responsibility; their relationship is primarily with you, not Pagetree.
7. Plans, billing, and Paddle
Some features require a paid subscription. Prices and plan details are shown at checkout. Payments are processed by Paddle.com Market Limited (“Paddle”), our merchant of record. By subscribing, you also agree to Paddle’s applicable terms and policies.
- Renewals — paid plans renew automatically each billing period unless you cancel before the renewal date.
- Cancellation — you may cancel anytime from your account or by contacting support; cancellation stops future charges. Access typically continues until the end of the current paid period.
- Price changes — we may change prices with reasonable notice; changes apply to subsequent billing periods.
- Taxes — prices may exclude taxes; Paddle may collect VAT or other taxes where required.
Refunds are governed by our Refund Policy.
8. Free tier and fair use
Free accounts are subject to usage limits (storage, pages, widgets, newsletter subscribers, etc.) shown in the product. We may throttle or suspend free accounts that abuse resources or violate fair use.
9. Intellectual property
Pagetree’s name, logo, software, design, and documentation are owned by us or our licensors. Except for the limited rights in these Terms, no license is granted. You may not copy, modify, or reverse engineer the Service except where law expressly allows.
If you believe content on Pagetree infringes your copyright, email [email protected] with details sufficient for us to locate the material and assess the claim.
10. Third-party services
The Service may integrate with third-party tools (OAuth login, embeds, analytics, payment providers, etc.). We do not control third parties and are not liable for their products, terms, or conduct.
11. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAGETREE AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) EUR 50.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
13. Indemnity
You agree to defend and indemnify Pagetree against claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.
14. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access immediately if you breach these Terms, if required by law, or if we discontinue the Service. Upon termination, your right to use the Service ends; sections that by nature should survive (including liability limits, indemnity, and governing law) will survive.
15. Changes to these Terms
We may update these Terms. We will post the new version on this page and update the “Last updated” date. Continued use after changes take effect constitutes acceptance. For material changes, we may provide additional notice by email or in the product.
16. Governing law and disputes
These Terms are governed by the laws applicable to the operator of Pagetree, without regard to conflict-of-law rules. Courts in that jurisdiction will have exclusive authority over disputes, unless mandatory consumer protection laws in your country require otherwise.
